Terms of Use

These are the conditions for using the macOS app "SoundSwitch" and its distribution site. The app is free, and downloading and using it requires agreeing to these terms. Please also read the Privacy Policy & Disclaimer.

1. Scope

These terms govern the use of the macOS application "SoundSwitch" (the "App") and the distribution site https://k386.sub.jp/SoundSwitch/ (the "Site"), both provided by the operator K386 (the "Operator").

By downloading, installing or using the App, you are deemed to have agreed to these terms. If you do not agree, please do not download or use the App.

2. Price

The App is provided free of charge. There are no fees, in-app purchases, subscriptions or advertisements. The Operator will never ask you to pay for the App.

3. License

Subject to your compliance with these terms, the Operator grants you a non-exclusive, non-transferable right to use the App as follows.

• You may install and use it on any number of Macs you manage, for personal or business use alike.
• Companies and organizations may use it without any additional license or notification.
• You are free to write about, review or demonstrate the App on social media, blogs, books and videos, including screenshots.

Copyright and other intellectual property rights in the App belong to the Operator or the respective rights holders. These terms do not transfer any of those rights to you.

4. Restrictions

When using the App or the Site, you must not:

• Sell, rent or redistribute the App for a fee, or attempt to do so.
• Redistribute the App's files anywhere other than this Site, including mirror sites, software directories that host the file itself, and file-sharing services. Writing about it is welcome; for distribution, please link to this Site.
• Decompile, disassemble or reverse engineer the App, except to the extent expressly permitted by law.
• Modify the App or distribute modified versions of it.
• Misrepresent the App's signature, notarization, version or developer information, or distribute files that impersonate the App.
• Use the App for any purpose that violates the law or public order.
• Use the App to infringe the rights of others, or to operate someone else's Mac without permission.
• Gain unauthorized access to the Site, place excessive load on it, or otherwise interfere with its operation.

5. Official source

This Site is the only official source for the App. The distributed file is signed with a Developer ID and notarized by Apple, and you can confirm it is unaltered using the SHA-256 value published on the download page.

The Operator has no knowledge of, and accepts no responsibility for, the integrity, safety or behavior of files obtained anywhere else.

6. No warranty

The App is provided AS IS. The Operator makes no warranty of any kind, express or implied, including but not limited to:

• Fitness for your particular purpose, usefulness, or that it will produce the results you expect.
• That it will work correctly on every Mac, every version of macOS, or every audio device.
• That it will be free of errors, defects or interruptions, or that any of these will be corrected.
• That it will always switch to the device you intended, or always keep the volume and mute state you intended.

7. Limitation of liability

The Operator accepts no liability whatsoever for any direct, indirect, incidental, special or consequential damages arising from the use of, or the inability to use, the App or the Site. This includes, without limitation:

• Damages caused by audio playing through an unintended device, or by recording with an unintended microphone.
• Failed meetings, streams, recordings or calls; missing audio; disclosure of information.
• Loss or corruption of data, malfunction of a Mac or audio hardware, business interruption, lost profits.
• Damages caused by changes in behavior following a macOS update, a device firmware update, or a conflict with another application.

Use the App at your own discretion and risk. Even where the Operator bears liability, it is limited to cases of the Operator's willful misconduct or gross negligence, and to a reasonable scope given that the App is provided free of charge.

8. Changes, suspension and discontinuation

The Operator may change the App's specifications, add or remove features, suspend or discontinue distribution, and change the contents of the Site, without prior notice. The Operator is not liable for any damages arising from such changes.

The App checks this Site for a newer version at launch and tells you when one exists. Installing it is your decision. The launch check can be turned off in Settings, and while it is off the App does not use the network except when you choose to check for updates.

9. Privacy

The App communicates only with this Site, and only to check for updates and to download an update you choose. Its settings are stored only on your own Mac. How information is handled is set out in the Privacy Policy & Disclaimer. Where these terms and that policy conflict, the policy prevails.

10. Changes to these terms

The Operator may revise these terms when necessary. Revised terms take effect when published on this page, and by downloading or using the App after publication you are deemed to have agreed to them. Significant changes will be noted with a revision date on this page.

11. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of Japan. Any dispute between you and the Operator concerning the App or the Site shall be submitted to the exclusive jurisdiction of the Japanese court having jurisdiction over the Operator's address as the court of first instance.

This is an independent, one-person project, so replies may take a few days.

Revision of September 24, 2026: articles 8 and 9 now describe network use as the App actually behaves (it goes online only to check for updates and to download an update you choose).
